The Buyer is bound by the general Terms and Conditions in force at the time of purchase (sending a web order/order by e-mail or phonecall). The conclusion of a purchase or confirmation of an order is considered a distance sales Contract between the Buyer and the Seller. Victory Organics d.o.o. reserves the right to change the Terms and Conditions of the website www.biofertilizer.victory-minerals.com at any time, without notice.

These Terms and Conditions have been drafted in accordance with the Customer Protection Act (Official Gazette, No. 41/2014) and the Civil Obligations Act (Articles 400-433) and are a prior notice within the meaning of Article 57 of the Customer Protection Act (Official Gazette 41/2014).

The Buyer can become any adult and legally capable person whose headquarters / residence is located in countries of Europan Union, and who accepts the Terms and Conditions of the company Victory Organics d.o.o. The acceptance of the Terms and Conditions Buyer confirms by ordering Products via Internet store, e-mail or phone.
The use of the services of the Online Store www.biofertilizer.victory-minerals.com is granted exclusively to adults. The use by children or minors is not allowed, and parents and / or guardians are obliged to take this into account, otherwise they assume all rights and obligations arising from such use, and the Seller is not responsible for any consequences of such use.
Types of users
By registering on www.biofertilizer.victory-minerals.com, you become a member of Victory Organics.
The right to purchase in the Victory Organics Online Store have registered members and a guest user, who makes quick purchases and does not have to register before purchasing.
When registering in the Online Store, the visitor receives a username that is identical to his e-mail address and his password.
If a user wants to replace their e-mail or password with another one, they can do so at any time on their user profile.
All prices contain VAT and are expressed in euros. Prices, payment terms and special offers are valid only at the time of order and may change without prior notice.
Product images and descriptions
The images are illustrative in nature and do not have to fully correspond to a particular item. The Seller tries to state as accurately as possible all the characteristics in the Product description and reserves the right to unintentional typographical errors, and is not responsible for any errors in the description and photo of the item.

When ordering by e-mail, it is necessary to provide the following information: name and surname of the Buyer, e-mail address of the Buyer, mobile phone number of the Buyer, address for invoicing and delivery (street, house number, postal code, place) and information about the desired Products (code, name, quantity). The primary way of communicating the Seller towards the Buyer is e-mail. Some Products may be unavailable or sold out. If the Seller is not able to deliver any of the ordered Products or all ordered Products, he will contact the Buyer and inform him about a possible subsequent delivery date. Upon receipt of such notification, the Buyer is obliged to inform the Seller by e-mail whether he accepts the delivery of the incomplete order, whether he accepts the new delivery deadline of the complete order or withdraws from the order. The Seller has the right to execute the order with the same selling terms through associated partner Company.
Paymentis made by cash on delivery when picking up the package at the Customer’s address, Internet banking, via PayPal or by direct transfer to the bank account: IBAN: 1623600001102728189 Zagrebacka Banka. Based on the confirmation of the Buyer’s order by the Seller, the goods are delivered after visible payment to the Seller’s account.
Purchase notification process
After placing an order, the Customer receives a notification via e-mail that the order has been received.
Victory Organics can call the Buyer on his contact phone number to check the details or ensure the accuracy of the delivery.
The purchase process for legal entities is exactly the same as for natural persons, except that at the end of the purchase you must specify the name and tax number of the company. Payment options are the same.
We deliver items to the countries of the European Union. Shipping costs outside the Croatian territory are to be defined. When ordering, the Buyer can indicate the address to which he wants the delivery of the package, which may differ from the Customer’s residence.
Delivery time of goods is within 5 working days, islands 8 working days or different compared to the delivery service options for items delivered from our warehouse. Purchased Products will be received by the Buyer at the address indicated in the order. In case of delay due to force majeure (lost Products, damaged Products in delivery, etc.), the Seller does not assume responsibility for any damage that could occur due to the delay of delivery to the Buyer, but undertakes to send a replacement Product as soon as possible, if it has it in its own warehouse. When taking over the purchased Products, the Buyer is obliged to check the possible damage to the shipment and immediately report it to the courier who delivered it, or refuse to take over the shipment on which external damage is visible. In this case, it is necessary to inform the Seller in order to organize a new delivery as soon as possible or to arrange further actions. If the Buyer does not receive the shipment according to the deadlines indicated above, and no longer than 14 days from the date of setting the status of the order “Delivered”, it is necessary to inform the Seller so that he can take action to find the shipment or send a replacement. The Buyer can check the status of the order by e-mail firstname.lastname@example.org or by phone call +385 52/384-511.
A discount code, or promotional code, brings a discount when purchasing through Victory Organics Internet store. The active code can be found on the Internet page, Victory Organics newsletter or in other media. The code brings convenience in the form of a discount. Every code is always time-limited and must be redeemed within a limited time frame, otherwise it is not valid.
Once you enter the promo code, the total amount of your order is automatically reduced by the value of the promo code. The total amount to pay remains. In the event that a person uses a discount code when purchasing, he has an advantage over regular special discounts. If a person does not use a discount code, a regular discount published in Internet store applies. A regularly published discount is excluded by a discount code and does not add up.
Victory Organics d.o.o. after delivery and payment of ordered Products, sends the invoice to the Customer in pdf format to the Customer’s e-mail or printed invoice on paper.
The invoice contains prices and all costs associated with the order. The Buyer is obliged to check the correctness of the data before ordering.
Customer’s right to terminate the purchase agreement
In the case of a distance Contract, the Customer has the right to inform the Seller within 14 days of receipt of the goods by e-mail email@example.com or any other communication channel, to terminate the Contract without having to state the reason for his decision. The Buyer must return the goods to the Seller no later than 14 days after sending the cancellation notice of the Contract, i.e. the purchase. The Customer returns the goods to: Victory Organics d.o.o., Kandlerova 8, 52100 Pula, Croatia. The only cost for the Customer regarding the withdrawal of the Contract is the direct cost of returning the goods. The Buyer must return the goods to the Seller undamaged and in unchanged quantity, unless the goods were destroyed, defective, lost or their quantity reduced, without being in contact with the Customer. When returning goods, the Buyer sends an invoice for goods and personal data and a transaction account to which he wants to receive a refund. The refund will be made no later than 14 days of receipt of the notice of termination of the Contract. In the event of termination of the Contract in which the promotional or discount code was used, these funds are taken into account as a discount and are not returned to the user. Only the paid amount is returned to the Customer’s account, and the promotional code is returned in the form of a new code.
The Buyer is entitled to a return of the goods in the following cases:
– delivery of goods that have not been ordered
– delivery of goods that have errors or damages that did not occur in transport
– other cases in accordance with the legal framework
The Buyer is obliged to notify the Seller in writing form or by e-mail firstname.lastname@example.org.
The Buyer can return the advertised Products or Products for which he is entitled to a refund through the delivery service. The cost of delivery through the delivery service is payed by the Buyer.
After receiving the returned or advertised Products, the Seller will check the justification of the request, and inform the Buyer about the result of the verification by e-mail. In the event of a justified request for a refund or complaint within 14 days of receipt of the shipment with returned or advertised Products, the Seller will pay the amount in the sales value of the returned or advertised Product to the transaction account of the Buyer.
The Seller will contact the user through means of distance communication only if that user does not expressly object. Advertising e-mail messages must contain the following components: they will be clearly indicated as promotional messages, the sender will be clearly visible, various promotions and other marketing techniques will be marked as such, participating conditions in them will be clearly defined: the method of unsubscribing to receive advertising messages will be clearly shown. The Seller will expressly respect the user’s wishes in case he does not want to receive advertising messages.
Ratings, reviews, opinions and recommendations
Victory Organics Internet store and all information about it, Product images, graphic and video elements on the website are protected and are not allowed to be reproduced or used without prior written permission.
The Seller does his best to ensure the up-to-dateness and accuracy of the information published on his site. Despite this, the characteristics of the Product, the delivery time or the price can change so quickly The Seller fails to correct all the information on the website. In this case, the Seller will notify the Buyer of the changes and allow him to terminate the Contract or to replace the ordered Product.
Exclusion from liability
Victory Organics d.o.o. reserves the right to disable access to the website due to technical or other problems and maintenance, which means disabling or interfering with the use of the web store. In case of technical problems on the website, we reserve the right to cancel orders affected by a technical error. In case of cancellation of orders, we will notify you as soon as possible and inform you of the next steps. The Customer must provide appropriate protective equipment (antivirus, etc.) to access and use the website. The Buyer must ensure the appropriate security and confidentiality of the data used to log in to the website (e-mail, password). Suppliers, manufacturer and distributors are not liable for the individual use of ekofertile™ Products.
Complaints and disputes
The Seller complies with applicable European Customer protection legislation. The Seller strives to fulfill his duty to establish an effective complaint handling system and identify the person with whom, in case of difficulties, the Buyer can connect by phone or e-mail.
The complaint is submitted by e-mail email@example.com. The complaint processing process is confidential. The Seller will confirm the received complaint within five working days, and will inform the Buyer about how long the complaint will be dealt with and inform him at any time of the progress of the procedure.
The Seller is aware that an essential characteristic of the Customer dispute, at least as far as the court decision is concerned, is the disproportion between the economic value of the claim and the costs incurred in the resolution of the dispute itself.
This is also the main obstacle not to bring a dispute in court. Therefore, the Seller strives to do everything in his power to resolve any dispute amicably. In the case of resolving litigation, the court of jurisdiction is Commercial court in Pazin, Dršćevka 1, 52000 Pazin.
